- Primero. REVOCAR el fallo del 8 de septiembre de 1999, proferido por el Juzgado 53 Civil Municipal de Santa Fe de Bogota, por medio del cual se nego la proteccion solicitada. En su lugar, se concede la tutela de los derechos a la vida, a la salud y a la seguridad social del nino Hermes Urquijo Vidales.
- En consecuencia, se ORDENA a "EPS Convida" que, en el termino de cuarenta y ocho (48) horas, contadas a partir de la notificacion de este fallo, si asi lo estima el medico tratante, o en la oportunidad que el lo indique, bajo su responsabilidad profesional, practique la cirugia coclear que requiere el paciente.
- Se inaplican para este caso, analizadas las circunstancias del menor, por resultar incompatibles con la Constitucion, el Decreto 806 de 1998 y la Resolucion 5261 de 1994 del Ministerio de Salud, que excluyen del POS la atencion del nino.
- Segundo. DESE cumplimiento a lo previsto en el articulo 36 del Decreto 2591 de 1991.
