- PRIMERO. REVOCAR la sentencia proferida por el Juzgado Treinta y Dos Penal Municipal de Cali el 17 de mayo de 2001 dentro del proceso identificado con el número de radicación 2001-0233, promovido por el señor Justo Germán Gutérrez Arroyabe.
- SEGUNDO. En su lugar, CONCEDER la tutela de los derechos a la salud y una vida digna del señor Justo Germán Gutiérrez Arroyabe y en consecuencia ORDENAR a la Empresa Promotora de Salud Coomeva E.P.S. S.A. que en el término de diez (10) días, contados a partir de la notificación de esta sentencia, programe la cirugía que requiere el señor Gutiérrez Arroyabe, y cubra el costo del lente intraocular y de los medicamentos que se requieran durante la cirugía.
- TERCERO. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
