- Primero. REVOCAR la sentencia expedida por el Juzgado 25 Penal del Circuito de Medellín, el 11 de junio de 1999.
- Segundo. INAPLICAR el artículo 61 del decreto 806 de 1998 para este caso concreto; ORDENAR a Salud Total E.P.S. que, dentro de los diez (10) días calendario siguientes a la notificación de esta providencia, practique todos los exámenes prequirúrgicos necesarios para llevar a cabo la cirugía de catarata en el ojo derecho del demandante y que, dentro del mismo término, programe el procedimiento, el cual deberá practicarse, a más tardar, dentro del mes siguiente a la notificación de esta sentencia.
- Tercero. SEÑALAR que a Salud Total E.P.S. le asiste el derecho de repetir lo que pague en cumplimiento de la orden emitida en el numeral anterior, ante la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud.
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
