- Primero. REVOCAR la sentencia pronunciada dentro del presente asunto por el Juzgado Veinte Civil Municipal de Medellín, el 11 de diciembre de 1997, que rechazó por improcedente la acción de tutela iniciada por Alfonso Correa Toro contra Coomeva E.P.S.
- Segundo. TUTELAR el derecho a la vida del peticionario, ordenando a Coomeva E.P.S., seccional Medellín (Laureles) que, en el improrrogable término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, inicie las sesiones de quimioterapia requeridas por el demandante, sin exigirle el mínimo de semanas cotizadas de acuerdo con la resolución 5261 de 1994, de conformidad con lo sentado en la parte motiva de esta sentencia.
- Tercero. SEÑALAR que Coomeva E.P.S puede repetir los sobrecostos en que incurra cumpliendo esta orden de la Sala, en contra del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social Integral en Salud, subcuenta de enfermedades catastróficas o ruinosas.
