- Primero. REVOCAR la sentencia de segunda instancia proferida el diez (10) de abril de dos mil dos ( 2002), por el Juzgado Penal del Circuito de la Mesa, y CONFIRMAR el fallo de primera instancia, proferido el veinticinco (25) de febrero de dos mil dos (2002) por el Juzgado Promiscuo Municipal de Apulo- Cundinamarca al negar la tutela interpuesta por el señor ULICER GARCIA PATIÑO.
- Segundo. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
