- Primero. CONFÍRMASE la sentencia proferida por el Consejo de Estado el veintiséis (26) de abril de mil novecientos noventa y seis (1996), pero por las razones expuestas en la parte motiva de esta providencia. Igualmente, se mantendrá la orden proferida por el Tribunal Administrativo del Chocó, a la Dirección Regional de Fiscalías de ese circuito judicial, para que se investigue al señor Alfonso Areiza Lozano, por la supuesta comisión del delito de falsedad testimonial.
- Segundo. COMUNÍQUESE la presente decisión al Tribunal Administrativo del Chocó, para que sea notificada a las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
