- PRIMERO. REVOCAR la sentencia proferida por el Juzgado Quince Civil Municipal de Cali el 20 de abril de 2004, mediante la cual se nego el amparo solicitado por el senor Cristian Fernando Molina Varela contra la ARS Humana Vivir S.A. EPS.
- SEGUNDO. DECLARAR la carencia actual de objeto de la citada solicitud de tutela.
- TERCERO. ORDENAR que la Secretaria General de esta Corporacion expida y envie copia de esta sentencia a la Superintendencia Nacional de Salud para que, si lo considera del caso, inicie una actuacion administrativa contra Humana Vivir S.A. EPS a fin de establecer si hay lugar a la imposicion de las sanciones de que trata el articulo 230 de la Ley 100 de 1993.
- CUARTO. DAR por secretaria cumplimiento a lo dispuesto en el articulo 36 del Decreto 2591 de 1991.
