- Primero. REVOCAR la sentencia proferida el nueve (9) de julio de 2004 por el Juzgado 18 Laboral del Circuito de Bogotá por medio de la cual negó el amparo deprecado por la señora Ana Silvia Peña de Gardeazábal en la el proceso de tutela que ésta inició contra el Instituto de Seguros Sociales.
- En su lugar, CONCEDER a la actora el amparo al derecho a la continuidad en la prestación del servicio de salud, en conexidad con el derecho fundamental a la integridad personal.
- Segundo. ORDENAR al Instituto de Seguros Sociales que en lo sucesivo entregue a la señora Ana Silvia Peña de Gardeazábal, de manera oportuna y de acuerdo con las fórmulas de los médicos tratantes de la señora, los medicamentos que ésta requiere, en especial aquel denominado Tamoxifen por 20 mg.
- Tercero. LÍBRESE por secretaría la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
