- PRIMERO. REVOCAR la sentencia proferida por el Juzgado 49 Penal Municipal de Bogotá el 5 de junio de 2002, en virtud de la acción de tutela interpuesta por Nelly Sofía Castro de Cuervo, en contra de la Caja de Previsión de Comunicaciones, CAPRECOM, y en su lugar CONCEDER la tutela a favor de Nelly Sofía Castro de Cuervo.
- SEGUNDO. ORDENAR a la Caja de Previsión de Comunicaciones, CAPRECOM, que en el término quince días corrientes (15) practique a la señora Nelly Sofía Castro de Cuervo la sutura mecánica circular ordenada por su médico tratante, en caso de ser ésta necesaria al momento de la notificación del presente fallo.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
