- Primero. REVOCAR sentencia proferida por el Juzgado
- Primero. Civil Municipal de Bogotá, en el trámite de la acción de tutela instaurada por Zulia Valbuena Mosquera contra la Secretaria de Educación del Distrito de Bogota D.C. En su lugar, CONCEDER el amparo a los derechos del menor DAVID CAMILO MOLANO.
- Segundo. ORDENAR a la Secretaría de Educación del Distrito de Bogotá, que en cuanto exista la primera vacante en la jornada de la tarde, de un tratamiento preferencial a la demandante, por las razones que aquí se expusieron. De no existir una vacante en el término de tres meses, se ordena igualmente a la Secretaría de Educación que disponga lo necesario para que el directivo docente rector del centro educativo donde labora la accionante, distribuya y adapte su horario de acuerdo con las necesidades de la accionante y teniendo en cuenta lo que aquí se decide.
- Tercero. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
