- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Civil del Circuito de El Banco (Magdalena) el día veintiuno (21) de abril de mil novecientos noventa y ocho (1998).
- Segundo. CONCEDER la tutela solicitada. En consecuencia se ordena al Alcalde del Municipio de San Sebastián de Buenavista (Magdalena) que cuando ocurra la primera vacante para el casco urbano se de tratamiento preferencial al demandante Martín Atencia Montero para que simultáneamente continúe laborando, recibiendo el tratamiento médico adecuado y supere la enfermedad que lo aqueja.
- Tercero. LÍBRENSE, por Secretaría General, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
