- Primero. REVOCAR la sentencia proferida el Juzgado
- Primero. Laboral del Circuito de Montería, en primera y única instancia, por medio de la cual negó el amparo deprecado por Rosa Camila Mestra Yañez como agente oficioso de Antonio Norberto Mestra Mestra contra la Caja Nacional de Previsión Social CAJANAL - E.P.S de Montería
- En su lugar CONCEDER la tutela del derecho a la salud en conexidad con el fundamental a la vida de Antonio Norberto Mestra Mestra.
- En consecuencia ORDENAR a la Caja Nacional de Previsión Social, CAJANAL - E.P.S de Montería, suministrar en un término de cuarenta y ocho horas (48), si no lo ha hecho aún, al señor Antonio Norberto Mestra Mestra el medicamento denominado Zoladex, cada vez que aquel la requiera y cuando así lo ordene el médico tratante.
- Segundo. ADVERTIR a la Caja Nacional de Previsión Social, CAJANAL - E.P.S de Montería, entidad demandada, que le asiste el derecho de repetir por lo que pague en cumplimiento de este fallo de tutela y que no se encuentre incluido en el P.O.S. ante el Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud (FOSYGA),
- Segundo. LÍBRESE por secretaría la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
