- Primero. Revocar las sentencias proferidas el 28 de julio y el 5 de septiembre de 2003 por los Juzgados
- Cuarto. Civil Municipal y
- Décimo. Civil del Circuito de Medellín.
- Segundo. Tutelar los derechos fundamentales a la vida, a la integridad personal y a la dignidad de Magnolia Vásquez Ospina.
- Tercero. Ordenar a Susalud EPS que en las 48 horas siguientes a la notificación de este pronunciamiento, remita a Magnolia Vásquez Ospina a una evaluación por oncología y suministre los tratamientos y medicamentos prescritos por tales especialistas.
- Cuarto. Declarar que a Susalud EPS le asiste el derecho de repetir contra el Fondo de Solidaridad Social en Salud, lo que pague en cumplimiento de lo establecido en la presente sentencia.
- Quinto. DÉSE cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
