- Primero. REVOCAR la sentencia proferida por el Juzgado Treinta y Cinco Civil del Circuito de Bogotá D. C. el 25 de septiembre de 2003 y, en su lugar, CONCEDER la tutela de los derechos fundamentales a la salud y a la seguridad social de la niña Andrea Elizabeth Venegas Gualteros, representada por su padre, señor José Eliécer Venegas Sánchez.
- Segundo. ORDENAR al representante legal del Seguro Social E.P.S. que en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia disponga lo necesario para la atención médica integral a la menor Andrea Elizabeth Venegas Gualteros, con el objeto de restablecer su estado de salud física y psíquica.
- Tercero. ADVERTIR que el Seguro Social E.P.S. está facultado para repetir en contra de Seguridad Asesorías y Controles Limitada - Ascontroles Ltda. por los gastos en que incurra por la atención en salud de la menor Andrea Elizabeth Venegas Gualteros. Esto sin perjuicio de la continuación de los trámites administrativos y judiciales tendientes a obtener el pago de los aportes al sistema de seguridad social en salud por parte de la dicha sociedad comercial.
- Cuarto. Por Secretaría General líbrense las comunicaciones previstas en el artículo 36 del Decreto Ley 2591 de 1991.
