- Segundo. Civil Municipal de Buenaventura y la sentencia proferida el 1deg de agosto de 2002 por el Juzgado
- Segundo. Civil del Circuito de esa ciudad.
- Segundo. Tutelar el derecho a la seguridad social en salud de Ever Wilson Asprilla Klinger y Martha Cecilia Mosquera Estupinan. En consecuencia, se le ordena al representante legal de la Industria de Pesca Sobre el Pacifico que en el termino de las 48 horas siguientes a la notificacion de este pronunciamiento, provea lo necesario para que al actor y a su companera se les preste el servicio de seguridad social en salud, servicio que estara a su cargo hasta tanto se ponga al dia en el pago de los aportes con Coomeva E.P.S.
- Tercero. Tutelar el derecho a la seguridad social en salud y a la vida de la menor Danna Rachel Asprilla Mosquera. En consecuencia, se le ordena al representante legal de Coomeva E.P.S. que en las 48 horas siguientes a la notificacion de este pronunciamiento, preste el servicio de seguridad social en salud requerido por la citada menor.
- Cuarto. Negar la tutela del derecho fundamental al debido proceso.
- Quinto. DESE cumplimiento a lo dispuesto en el articulo 36 del Decreto 2591 de 1991.
