- Primero. REVOCAR la sentencia proferida por el Tribunal Superior del Distrito Judicial de Bogota - Sala Civil - de fecha veintitres (23) de marzo de 2004, y, en su lugar, CONCEDER la tutela de los derechos consagrados en los articulos 13, 42, 43 y 44 de la Constitucion Politica dentro de la accion instaurada por la senora Esperanza Chavez Fonseca contra la Empresa Nacional de Telecomunicaciones, Telecom - en liquidacion.
- Segundo. ORDENAR a la Empresa Nacional de Telecomunicaciones Telecom - en liquidacion, que reintegre en sus labores a la senora Esperanza Chavez Fonseca dentro de las cuarenta y ocho (48) horas siguientes a la notificacion del presente fallo, como beneficiaria del "reten social", hasta la terminacion definitiva de la existencia juridica de la empresa.
- Cuarto. LIBRESE por secretaria la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
