- Primero. REVOCAR el fallo proferido por el Juzgado
- Tercero. Penal Municipal de Girardot, que negó el amparo solicitado por el señor ENRIQUE DIAZ YEPES.
- Segundo. INAPLICAR el artículo 61 del Decreto 806 de 1998 para este caso concreto, por ser contrario al artículo 4 de la Constitución Política. En consecuencia ORDENAR a la E.P.S. SANITAS que en el término de quince (15) días siguientes, contados a partir de la notificación de esta sentencia, se autorice y practique la cirugía de histerectomía abdominal, si no le hubiere sido practicada, a la señora MARIBEL SUÁREZ CUEVAS, para lo cual se deberá consultar al médico que por cuenta de la E.P.S. SANITAS le prestaba la atención médica, y que se practiquen todos los exámenes que pudiera requerir con miras a la realización de la cirugía. Además, se le brindará todo el cuidado inmediato que requiera durante el post-operatorio y relacionado directamente con la cirugía practicada.
- Tercero. SEÑALAR que a SANITAS E.P.S. le asiste el derecho de repetir lo que pague en cumplimiento de la orden emitida en esta sentencia, ante la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud.
- Cuarto. Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
