PRIMERO. REVOCAR, por las razones expuestas en la presente sentencia, el fallo de tutela dictado por el Juzgado Cuarenta y siete Civil Municipal de Bogota el 27 de febrero de 2004, por medio del cual se nego la accion de tutela entablada por Victor Omar Barbosa Arevalos en contra de la E.P.S. Sanitas de Bogota.
SEGUNDO. TUTELAR el derecho a la salud en conexidad con la vida, seguridad social e integridad fisica del demandante. En CONSECUENCIA, ordenar a la Entidad Promotora de Salud, Sanitas de Bogota, le realice la cirugia de cancer papilar de tiroides al accionante dentro del perentorio termino de cuarenta y ocho (48) horas a partir de la notificacion personal de esta providencia.
TERCERO. SENALAR expresamente que la E.P.S. Sanitas de Bogota, podra repetir contra el FOSYGA lo que desembolse por concepto de la orden dada en este fallo.
CUARTO. LIBRESE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
