- Primero. REVOCAR la sentencia proferida por el Juzgado
- Séptimo. Penal del Circuito de Bucaramanga (Santander) que denegó la acción de tutela de la referencia. En su lugar CONCEDER la protección constitucional a los derechos fundamentales a la salud y a la vida digna de la señora María Cecilia Rueda Serrano.
- Segundo. ORDENAR al Gerente del Seguro Social Seccional Santander para que en el término de cuarenta y ocho (48) horas siguientes a la notificación del fallo, - si aún no lo hubiere hecho - disponga lo necesario para que bajo la responsabilidad profesional de los facultativos que traten a la accionante y en la oportunidad que ellos indiquen, le sea practicado el procedimiento quirúrgico que requiere según lo prescrito por el médico tratante y se le brinde toda la atención médica que llegare a necesitar, en aras de restablecer sus derechos a la salud y a la vida en condiciones dignas.
- Tercero. Enviar a la Contraloría General de la República y a la Superintendencia Nacional de Salud, las copias indicadas en la parte motiva de esta sentencia y para los fines explicados en ella.
- Cuarto. El Juzgado
- Séptimo. Penal del Circuito de Bucaramanga velará por el cumplimiento de esta providencia de conformidad con lo ordenado en el artículo 27 del Decreto 2591 de 1991.
- Quinto. El desacato de esta sentencia será sancionado como lo prevé el artículo 52 del Decreto 2591 de 1991.
- Sexto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
