- Primero. Revocar el fallo proferido por el Juzgado Veinte Penal del Circuito de Medellín el 29 de agosto de 2003, dentro del proceso de la acción de tutela instaurada por Luis Hernán Alzate Martínez, Personero Municipal de Cocorná (Antioquia), y en su lugar conceder la protección del derecho fundamental a la salud de la menor Olga Margarita Toro Gómez.
- Segundo. Ordenar a la Dirección Seccional de Salud de Antioquia que en el término de cinco (5) días, contados a partir de la notificación de esta sentencia, se tomen las medidas necesarias, si no se ha hecho aún, para que a Olga Margarita Toro Gómez le sea practicada la cirugía de estrabismo ojo derecho e izquierdo ordenada por su médico tratante. La entidad podrá cobrar al Estado, a través del Fosyga, todos los gastos en los que incurra y que legalmente no le corresponda asumir, en forma completa y oportuna, en un plazo no mayor de seis (6) meses después de presentada la cuenta correspondiente.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
