- PRIMERO. REVOCAR la sentencia del Juzgado
- Sexto. Civil Municipal del 10 de octubre de 2002 y en su lugar CONCEDER la tutela al derecho a la salud en conexidad con la vida del señor Jesús Antonio Hernández, por los motivos expuestos en la parte considerativa de esta sentencia.
- SEGUNDO. ORDENAR al Seguro Social, Seccional Cali, que en el término de cuarenta y ocho horas (48) posteriores a la notificación de la presente sentencia realice las gestiones necesarias para el suministro de las sesiones de terapia con máquina pasiva de hombro programadas por el médico tratante al señor Jesús Antonio Hernández y siga prestando los servicios médicos requeridos, hasta el monto cubierto por el SOAT.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juzgado de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
