- Primero. REVOCAR el fallo proferido el 24 de octubre de 2000 por el Juzgado
- Quinto. Penal Municipal de Villavicencio.
- Segundo. CONCEDER la tutela de los derechos a la salud, a la integridad personal y a la vida en condiciones dignas de la señora Esther Luisa Pérez Vanegas.
- Tercero. INAPLICAR por inconstitucional, para el caso concreto, el artículo 26 del Decreto 1938 de 1994.
- Cuarto. ORDENAR a la E.P.S. SaludCoop, que en el término de quince (15) días siguientes a la notificación de la presente providencia, autorice y practique la cirugía recomendada por el médico tratante, si aún no le hubiere sido practicada, cubriendo su costo total, sin exigir porcentaje a la señora Esther Luisa Pérez Vanegas.
- Quinto. SEÑALAR que a SaludCoop E.P.S. le asiste el derecho a repetir lo que pague en cumplimiento de la orden emitida en este fallo, ante la subcuenta correspondiente del FOSYGA, que deberá reconocer ese valor dentro de los treinta (30) días siguientes a aquél en que se envíe la cuenta de cobro respectiva.
- Sexto. Por Secretaria General, líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
