- Primero. REVOCAR la sentencia proferida por la Sala de Casacion Civil Agraria de la Corte Suprema de Justicia. En su lugar, tutelar el derecho a la salud en conexidad con la integridad fisica.
- Segundo. INAPLICAR el numeral 2deg del paragrafo A del articulo
- primero. del Acuerdo No. 30 de 1988 del Consejo Directivo Nacional del SENA, y ORDENAR al Servicio Medico Asistencial del SENA, Seccional Bogota Cundinamarca, que en el termino de cinco (5) dias habiles contados a partir de la notificacion de la presente providencia, realice la intervencion quirurgica pendiente y prosiga con el tratamiento al que debe ser sometido el joven, hasta su finalizacion, de conformidad con las prescripciones de los medicos tratantes.
- Tercero. Por Secretaria General, librese la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
