- Primero. Revocar la sentencia proferida por el Juzgado
- Tercero. Laboral de Valledupar y en su lugar conceder la tutela del derecho fundamental al mínimo vital del ciudadano Néstor Jaime Peña Rueda.
- Segundo. Ordenar al Representante Legal de la Penitenciaría Nacional de Valledupar que, si no lo ha hecho para el año en curso, haga entrega efectiva de los objetos que componen la dotación de los internos, en los términos del artículo 62 de la resolución 0139 de 2003, por la cual se expide el Reglamento de Régimen Interno de dicho establecimiento.
- Tercero. Compulsar copia íntegra del expediente de la referencia con destino a la Procuraduría General de la Nación, con el fin de que dicha autoridad, de encontrarlo pertinente, adelante la investigación sobre los hechos alegados por el ciudadano Néstor Jaime Peña Rueda que dieron lugar a su solicitud de amparo.
- Cuarto. Por Secretaría General librar las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
