- Primero. Revocar las sentencias proferidas por el Juzgado Penal del Circuito de Acacías y la Sala Penal del Tribunal Superior de Villavicencio y en su lugar conceder la tutela del derecho fundamental a la salud al ciudadano Jairo Benavides.
- Segundo. Confirmar las sentencias proferidas por el Juzgado Penal del Circuito de Acacías y la Sala Penal del Tribunal Superior de Villavicencio, en el sentido de prevenir a la Dirección del penal de Acacías para que, en el menor tiempo posible, le fueran practicados los exámenes prescritos al interno Jairo Benavides.
