- PRIMERO. REVOCAR la sentencia proferida por el Juzgado Veintiuno Civil Municipal de Barranquilla el 28 de septiembre de 2004. En consecuencia, CONCEDER la tutela de los derechos fundamentales a la maternidad, a la proteccion del recien nacido y al minimo vital de la senora Katherine Navas Maldonado y su hijo.
- SEGUNDO. ORDENAR a la E.P.S. Salud Total de Barranquilla que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion del presente fallo, proceda a pagar a la senora Katherine Navas Maldonado el valor de la licencia por maternidad que le corresponde.
- TERCERO. LIBRESE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
