- PRIMERO. REVOCAR las sentencias proferidas por la Sala de Casación Penal de la Corte Suprema de Justicia, el 5 de septiembre de 2000; y por la Sala Civil del Tribunal Superior de Bogotá, el 12 de julio de 2000. En su lugar, CONCEDER el amparo del derecho a la salud en conexidad a la vida del actor.
- SEGUNDO. ORDENAR a la dirección de la Cárcel La Modelo que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de la presente sentencia, autorice y facilite la práctica de la cirugía que requiere el actor, de acuerdo con los conceptos médicos, si aún no se hubiere practicado.
- TERCERO. COMUNICAR la presente sentencia al Defensor del Pueblo y al Director de la Cárcel La Modelo
- CUARTO. Por Secretaría líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
