- Primero. INAPLICAR por inconstitucional, para el caso concreto, el artículo 18 de la Resolución 5261 de 1994.
- Segundo. REVOCAR la sentencia proferida por el Juzgado
- Noveno. Laboral del Circuito de Medellín, por medio de la cual se negó la acción de tutela impetrada por Luz Stella Vasco Cardona, contra Susalud E.P.S., y, en consecuencia, CONCEDER la tutela del derecho a la salud, en conexidad con el derecho a la vida digna, a la integridad física, y a no ser objeto de tratos inhumanos, crueles o degradantes.
- Tercero. ORDENAR al Representante Legal de Susalud E.P.S., que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, disponga lo necesario para llevar a cabo el examen médico ordenado con el fin de determinar si la señora Luz Stella Vasco Cardona requiere ser intervenida quirúrgicamente y, en caso afirmativo, autorizar de manera inmediata la indicada operación, lo cual deberá acreditar ante el Juzgado
- Noveno. Laboral del Circuito de Medellín.
- Cuarto. LÍBRESE por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
