- Primero. Revocar la sentencia de fecha cuatro (4) de septiembre del año dos mil (2000), del Juzgado
- Octavo. Civil del Circuito de Bucaramanga, en la acción de tutela presentada por Cecilia Villamizar de Meléndez contra Servir S.A. IPS.
- En consecuencia, por las razones expuestas en esta sentencia, se inaplica el parágrafo del artículo 28 del Decreto 806 de 1998, y se ordena a Servir S.A. IPS, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta tutela, inicie las acciones pertinentes con Cajanal EPS, para que a la demandante se le realice el examen requerido. Cajanal no puede negarse a ordenar la realización del mismo, bien directamente, o a través de la entidad que contrate para tal efecto.
- Segundo. Por la Secretaría de la Corte Constitucional, remitir a Cajanal EPS copia de esta sentencia, para lo de su competencia.
- Por Secretaría General líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
