Primero. REVOCAR la decisión proferida por la Sala Civil del Tribunal Superior de Medellín, el 3 de diciembre de 1998. INAPLICAR el artículo 10 del decreto 806 de 1998 y el literal o) del artículo 18 de la resolución 5261 de 1994
Segundo. TUTELAR el derecho a una vida digna y a la salud en conexión con él que le asisten a Hernán de Jesús Trujillo Tobón. En consecuencia, ordenar a Unimec E.P.S. que, en el término de los tres (3) días siguientes a la notificación de esta providencia, practique al demandante la manometría esofágica y PH esofágico 24 horas, según recomendación del médico tratante.
Tercero. Unimec E.P.S. podrá repetir lo gastado en cumplimiento de la orden emitida en el numeral anterior, en contra de la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social en Salud (Fosyga).
Cuarto. Líbrense por Secretaria General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
