- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E :
- Primero. REVOCAR la Sentencia proferida el 25 de septiembre de mil novecientos noventa y siete (1997) por el Juzgado
- Quinto. Civil Municipal de Santafe de Bogota, en el proceso de tutela incoado por la senora Lesvia Ruth Gaviria Aristizabal en contra del Jefe de Seccion y Prestaciones Sociales, Unidad de Prima y subsidio de la Policia Nacional, por las razones expuestas en esta sentencia.
- Segundo. CONCEDER la proteccion del derecho a la seguridad social de la menor Kelly Tatiana Hoyos. Para tales efectos, se ORDENARA a la Policia Nacional, Division de Prestaciones Sociales, que dentro de las cuarenta y ocho horas (48) siguientes a la notificacion del presente fallo, RELIQUIDE la pension recibida por la madre, con base en el incremento porcentual que le corresponde a su hija por concepto del subsidio familiar.
- Tercero. LIBRESE por la Secretaria General de esta Corporacion, la comunicacion de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli previstos.
