Revocar la sentencia del Juzgado Veintiuno Penal del Circuito de Cali, de fecha diez y ocho (18) de junio de dos mil tres (2003) en la acción de tutela presentada por Lady Adriana Burbano Ceballos contra Salud Total EPS y Carrillo Abogados Asociados Ltda. En consecuencia se concede la tutela para la protección de los derechos fundamentales a la maternidad, seguridad social y a la protección del recién nacido.
Para tal efecto se ordena a Salud Total EPS, que en el término de cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, si aún no lo hubiere hecho, proceda a reconocer y pagar a favor de la demandante el valor de la licencia de maternidad a que tiene derecho.
Como se advirtió en la parte motiva de esta providencia la EPS puede repetir contra el Fosyga y Carrillo Abogados Asociados Ltda. la parte proporcional al pago aquí ordenado.
Por Secretaría General líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
