- Primero. REVOCAR la sentencia proferida por el Juzgado Treinta y Cinco Civil del Circuito de Bogotá dentro del asunto de la referencia, en cuanto denegó el amparo de los derechos a la salud y a la seguridad social en conexidad con el la vida. En su lugar, CONCEDER la tutela de los mencionados derechos de la señora Ana Gilma Caro de Sánchez.
- Segundo. ORDENAR al representante legal del SEGURO SOCIAL E.P.S., o a quien haga sus veces, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, si es que aún no lo ha hecho, se autorice la práctica del procedimiento quirúrgico que requiere la afiliada Ana Gilma Caro de Sánchez.
- Tercero. El Seguro Social E.P.S. podrá repetir contra el Fondo de Solidaridad y Garantías Financieras por los gastos adicionales en que llegare a incurrir y que estuvieren excluidos de la cobertura del plan obligatorio de salud.
- Cuarto. Por Secretaría General dése cumplimiento a lo previsto en el artículo 36 del decreto 2591 de 1991.
