- Primero. CONFIRMAR el fallo proferido por la Sala Laboral del Tribunal Superior del Distrito Judicial de Bogotá, D.C., mediante el cual se dispuso tutelar los derechos fundamentales del señor Guillermo Castillo Pérez y se ordenó a COLMENA SALUD EPS complementar la cobertura económica en un 100% respecto del procedimiento e intervención quirúrgica practicados al accionante para que queden saldados los gastos ocasionados por el procedimiento realizado.
- Segundo. CONFIRMAR el fallo proferido por el Juzgado Cincuenta y Dos civil Municipal de Bogotá, D.C., mediante el cual se ordenó a COLMENA SALUD EPS reanudar por intermedio del Centro Médico Monserrate y/o el Hospital Universitario de San Ignacio de Bogotá, D.C., el tratamiento médico especializado y el suministro de medicamentos requeridos por la señora Margy María Manasse Vargas.
- Tercero. Con fundamento en el artículo 4º. de la Carta, inaplicar para los casos sometidos a revisión las normas reglamentarias del Plan Obligatorio de Salud, por ser contrarias al los artículos 48 y 49 de la Constitución Política. Se señala que a COLMENA SALUD EPS le asiste el derecho de repetir lo que pague en cumplimiento de esta sentencia, ante la subcuenta respectiva del Fondo de Solidaridad y Garantía del Sistema General de Seguridad Social en Salud.
- Cuarto. Líbrense por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
