Derecho a la salud la vida y la dignidad humana de afiliada en calidad de beneficiaria a quien le fue diagnosticada obesidad g3 morbida que le ha deteriorado su estado de salud y a quien su medico le ordeno la practica de una cirugia bariatrica que la entidad se niega a autorizar por tratarse de un procedimiento no pos.
Solicita se ordene autorizar y cubrir el 100% de la totalidad del costo de la cirugia bariatrica.
Derecho a la salud y procedencia de la accion de tutela para obtener la autorizacion y practica de un procedimiento excluido del pos.

- PRIMERO. REVOCAR el fallo dictado por el Juzgado Cuarenta y Uno (41) Penal del Circuito de Bogotá y en su lugar CONCEDER la tutela por los derechos fundamentales a la salud, a la vida y a la dignidad humana de la señora Elsa Suárez Moncada.
- SEGUNDO. ORDENAR a la EPS Seguro Social Seccional Cundinamarca que, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, si aún no lo ha hecho, autorice y practique la CIRUGÍA BARIATRICA en los términos prescritos por el médico tratante, sin que se pueda oponer para su negativa la reglamentación del POS.
- TERCERO. DECLARAR que si la EPS Seguro Social lo considera necesario puede reclamar ante el Fondo de Solidaridad y Garantía- FOSYGA- aquellos valores que no está obligada a soportar.
- CUARTO. Por secretaría General líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
