El demandante solicita se le autorice la entrega de la sutura para hombro con anclaje en titanio el cual no se encuentra incluido en el POS, dicho material se requiere para realizarle una cirugía de reparación de manguito rotador y acromioplastia, la cual ya se encuentra aprobada pero no se ha podido llevar a cabo por la falta de materiales.
La Sala recuerda los requisitos para solicitar mediante tutela un tratamiento médico excluido de la regulación legal y reglamentaria del derecho a la salud, durante el trámite de la acción se envió por parte de la entidad accionada el respectivo reporte, informando que la cirugía ya fue realizada, por lo tanto se declara la carencia actual de objeto por configurarse un hecho superado.

- Segundo. de Familia de Popayán - Cauca, del 09 de diciembre de 2009, dentro de la acción de tutela instaurada por el señor Melecio Reinerio contra la Nueva EPS por las consideraciones expuestas en esta providencia.
- Segundo. Declarar la carencia actual de objeto por configurarse un hecho superado en los términos explicados en esta sentencia.
- Tercero. Líbrense las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991, para los efectos allí contemplados.
