- R E S U E L V E :
- PRIMERO. Del fallo proferido el día nueve (9) de abril de mil novecientos noventa y dos (1992) por el Juzgado Penal Municipal de Suaita, Santander, respecto de la acción de tutela intentada por los señores JAIME SANTAMARIA TELLEZ, FLOR DE AGUDELO, CARLOS CASTELLANOS, GILMA DE ARGUELLO y
- SEGUNDO. BOHORQUEZ contra la Alcaldía Municipal de Suaita, Santander, se confirma parcialmente el fallo en cuanto se DENIEGA la acción de tutela, pero en razón a la cesación de la actuación impugnada, con fundamento en las razones anotadas anteriormente.
- SEGUNDO. Ordenar al Juzgado Penal Municipal de Suaita que haga la prevención a la Alcaldía Municipal de Suaita, con el fin de que dicha entidad se abstenga de incurrir en las acciones que dieron mérito para interponer la tutela, so pena de incurrir en las sanciones previstas en el Decreto 2591 de 1991.
- TERCERO. Líbrese por la Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991 para los efectos allí contemplados.
