- Primero. CONFIRMAR, por las razones expuestas en la parte considerativa del presente fallo, la Sentencia proferida por la Sala de Casacion Penal de la Corte Suprema de Justicia de fecha 28 de enero de 1999.
- Segundo. Exhortar a la Defensoria del Pueblo para que promueva ante las autoridades competentes, la afiliacion del personal de reclusos de las penitenciarias La Modelo, La Picota y El Buen Pastor de la ciudad de Santafe de Bogota, al Regimen Subsidiado de Seguridad Social en Salud que contempla la Ley 100 de 1993.
- Tercero. Llamar la atencion de la Defensoria del Pueblo para que en lo sucesivo no se entablen acciones para definir situaciones sobre las cuales ya ha mediado pronunciamiento por parte de la Jurisdiccion Constitucional.
- Cuarto. Surtase el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
