PRIMERO. REVOCAR los fallos de los Juzgados
Primero. Penal Municipal y
Segundo. Penal del Circuito de Calarcá, proferidos los días catorce (14) y veintinueve (29) de enero de mil novecientos noventa y tres (1993), respectivamente, y que denegaron la tutela solicitada por Francisco Javier Toro Alvarez.
SEGUNDO. CONCEDER la tutela de los derechos a la libertad de expresión, libertad de enseñanza, reunión y libre asociación, del señor Francisco Javier Toro Alvarez.
TERCERO. ORDENAR al Director de la Penitenciaria Rural de Peñas Blancas de Calarcá, permitir al Comité que preside Francisco Javier Toro Alvarez, reunirse en las aulas educativas del centro carcelario, y permitir que este pueda dictar cátedra o enseñar la Constitución Nacional y todo lo relacionado en materia de derechos humanos en las aulas educativas de este establecimiento carcelario, durante todo el tiempo que permanezca confinado, dentro de los horarios permitidos por los reglamentos.
QUINTO. LIBRAR comunicación al Juzgado
Primero. Penal Municipal de Calarcá, a efectos de que notifique esta sentencia a las partes y adopte las decisiones necesarias para adecuar su fallo a lo aquí dispuesto.
