Estatuto Tributario artículo 206, numeral 7, la norma regula las rentas de trabajo exentas y sus excepciones los apartes acusados son los siguientes “y de sus Fiscales”, “Para los Jueces de la República el porcentaje exento será del veinticinco por ciento (25%) sobre su salario”, el demandante considera que los apartes acusados vulneran los artículos 13, 95 -9 y 363 constitucionales, ya que no extiende la excepciones a los fiscales y los jueces, como si lo hizo respecto de los fiscales ante los magistrados del Tribunal.
La Corte encuentra que el actor incumplió con la carga argumentativa de demostrar que la expresión “fiscales”, es aplicable a dichos servidores, cuando la norma no estaba dirigida a regular la situación tributaria de los mismos, sino a otros de distinta naturaleza e índole funcional, por lo tanto decide declararse inhibida para adoptar una decisión de mérito.
