La demandante solicita declarar la inexequibilidad parcial del artículo 154 del Código Civil, modificado por la Ley 1° de 1976 y posteriormente por el artículo 6 de la Ley 25 de 1992.
Considera que la norma vulnera lo dispuesto en los artículos 13 y 16 de la Constitución Política, no porque las causales de divorcio generen en sí mismas una violación de los artículos citados, sino porque crea una desigualdad jurídica al no consagrar la posibilidad de solicitar el divorcio unilateral para las personas casadas por el rito civil.
