- PRIMERO. Declarar EXEQUIBLE el decreto 272 de 2000, en cuanto no hubo exceso en el ejercicio de las facultades extraordinarias que le fueron otorgadas al Gobierno, segun la ley 573 de 2000, salvo lo que se dispone en los ordinales
- TERCERO. y
- CUARTO. de la parte resolutiva de esta sentencia.
- SEGUNDO. Declarar EXEQUIBLES los arts. 1o y 17, numerales 3, 7, y 16, asi como el art. 35 del decreto 272 de 2000.
- TERCERO. Declarar EXEQUIBLE el numeral 12 del art. 17, salvo las expresiones "en forma excepcional" y "previa solicitud del gobierno departamental, distrital o municipal; de cualquier comision permanente del Congreso de la Republica; de la mitad mas uno de los miembros de las corporaciones publicas territoriales o de la ciudadania, a traves de los mecanismos de participacion ciudadana que establece la ley. Este control no sera aplicable a la Contraloria del Distrito Capital de Santafe de Bogota " que se declaran INEXEQUIBLES.
- CUARTO. Declarar INEXEQUIBLE el numeral 21 del art. 17 del decreto 272 de 2000.
