- En merito de lo expuesto, la Corte Constitucional
- R E S U E L V E
- PRIMERO. Declarar EXEQUIBLES las partes demandadas del articulo 2o de la Ley 42 de 1993.
- Paragrafo.- Respecto del Banco de la Republica y de las funciones que la Constitucion Politica le atribuye en el articulo 371, el control fiscal predicable de esta entidad solo estara circunscrito a los actos de gestion fiscal que realice y en la medida en que lo haga.
- SEGUNDO. Declarar EXEQUIBLE el articulo 42 de la Ley 42 de 1993, exclusivamente bajo los aspectos examinados.
- TERCERO. Declarar INEXEQUIBLE el articulo 108 de la Ley 42 de 1993 en la parte acusada.
