- Primero. CONFIRMAR el fallo proferido por la Sección Tercera del Consejo de Estado, el 3 de febrero de 2000, dentro de la acción de tutela interpuesta por Ana Omaira Tarazona Riveros contra la EPS Sanitas.
- Segundo. REVOCAR el fallo proferido por el Juzgado 1º Laboral del Circuito de Ibagué, el 2 de marzo de 2000. En su lugar CONCEDER la acción de tutela interpuesta por Magdi Alejandra Ferro Molina contra el Seguro Social.
- Tercero. REVOCAR el fallo proferido por el Juzgado 9º Penal Municipal de Barranquilla, el 22 de diciembre de 1999. En su lugar CONCEDER la acción de tutela interpuesta por Aura Luisa Guerra Arrieta contra el Seguro Social.
- Cuarto. ORDENAR a la EPS del Seguro Social, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, proceda a pagar la licencia de maternidad a Magdi Alejandra Ferro Molina y a Aura Luisa Guerra Arrieta.
- Quinto. ADVERTIR a la EPS del Seguro Social, que puede iniciar proceso de jurisdicción coactiva para el cobro de los valores dejados de percibir como consecuencia del incumplimiento en el pago de las cotizaciones a la seguridad social en salud, por parte de los empleadores de las señoras a cuyo favor se concede la acción de tutela.
- Sexto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
