- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Cuarto. Penal Municipal de Pereira. En consecuencia, conceder la tutela solicitada por la señora LUZ ANGELLY TARAZONA ACOSTA.
- SEGUNDO. INAPLICAR de conformidad con el artículo 4 de la Constitución Política y para este caso específico el parágrafo del artículo 12 de la resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7 del Acuerdo 08 de 1994, del Consejo Nacional de Seguridad Social en Salud.
- TERCERO. ORDENAR a la E.P.S. SALUD TOTAL, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a ordenar el efectivo suministro e implantación de los audífonos recetados por el médico tratante de la señora LUZ ANGELLY TARAZONA ACOSTA.
- CUARTO. AUTORIZAR a la E.P.S. SALUD TOTAL a repetir contra el FOSYGA, por el recobro de los dineros invertidos en el suministro de los audífonos en mención.
- QUINTO. LÍBRENSE las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
