- Primero. REVOCAR la sentencia proferida por la Sala Civil Familia del Tribunal Superior de Pasto.
- Segundo. INAPLICAR de conformidad con el artículo 4 de la Constitución Política y para este caso específico el parágrafo del artículo 12 de la resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7 del Acuerdo 08 de 1994, del Consejo Nacional de Seguridad Social en Salud.
- Tercero. ORDENAR a la I.P.S. PROSALUD, LTDA, Seccional Pasto, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta sentencia, proceda a ordenar el efectivo suministro e implantación de los audífonos recetados por el médico tratante del señor NESTOR BAUDILIO RIASCOS.
- Cuarto. AUTORIZAR a la I.P.S. Prosalud Ltda., para que efectúe ante el FOSYGA el recobro de los dineros invertidos en el suministro de los audífonos mencionados.
- Quinto. Por Secretaría líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
