- Primero. REVOCAR el fallo proferido por el Juzgado
- Quinto. Penal Municipal de Bogotá D.C. el 21 de noviembre de 2003, dentro del proceso de la acción de tutela instaurada por Aleida de Jesús Zapata García en representación de su hermana, y en su lugar conceder la protección de los derecho fundamentales a la salud y integridad de la señora
- Segundo. ORDENAR a la A.R.S. CAFAM que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente sentencia proceda a suministrar a Gloria Aracelly Zapata García, los audífonos ordenados por su médico tratante con las especificaciones indicadas por él.
- Tercero. ADVERTIR a CAFAM A.R.S., que podrá repetir contra el Estado específicamente contra Fondo de Solidaridad y Garantía (FOSYGA) en todos los gastos en los que incurra en cumplimiento de lo ordenado en este fallo y que no esté cubierto por el P.O.S-S
- Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
