- Primero. REVOCAR la sentencia proferida por el Juzgado
- Primero. Civil del Circuito de Cali. En consecuencia, conceder el amparo solicitado por el senor PEDRO NEL ARIAS VILLEGAS.
- Segundo. INAPLICAR de conformidad con el articulo 4 de la Constitucion Politica y para este caso especifico el paragrafo del articulo 12 de la resolucion 5261 de 1994, emitida por el Ministerio de Salud y el articulo 7 del Acuerdo 008 de 1994, del Consejo Nacional de Seguridad Social en Salud.
- Tercero. ORDENAR a la E.P.S. del INSTITUTO DE SEGURO SOCIAL I.S.S., que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, proceda a ordenar el efectivo suministro e implantacion de los audifonos ordenados por el medico tratante del senor PEDRO NEL ARIAS VILLEGAS.
- Cuarto. La E.P.S. del INSTITUTO DE SEGUROS SOCIALES I.S.S. podra repetir contra el FOSYGA, por la suma de los dineros invertidos en el cumplimiento de la orden emitida en este fallo.
- Quinto. Por Secretaria librese la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
