- Primero. REVOCAR la sentencia proferida por la Corte Suprema de Justicia, Sala de Casación Penal, el 29 de julio de 1999.
- Segundo. CONCEDER la tutela interpuesta por el señor Leonardo Cuervo Avila y, en consecuencia DEJAR SIN EFECTO por violación de los artículos 29 y 31 de la Constitución Política, en virtud de haber sido empeorada su situación como apelante único por parte del Juzgado Penal del Circuito de Chocontá, la providencia del 19 de marzo de mil novecientos noventa y nueve.
- Tercero. ENVIESE copia de la presente providencia al Juzgado Penal del Circuito de Chocontá para los efectos procesales pertinentes.
- Cuarto. Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
