- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E:
- Primero. Declárase EXEQUIBLE el artículo 430 del Decreto 2550 de 1988 (Código Penal Militar), excepto las expresiones "sin limitación alguna", que se declaran INEXEQUIBLES.
- Segundo. Declárase EXEQUIBLE la parte demandada del artículo 434 del mismo Código, que dice: "Procedencia.- La consulta procede en las siguientes providencias: 1. Sentencias de primera instancia".
